RESULTS Survival of CYP7A1 and hCYP7A1 CYP7A1 mice. In the original characterization of homozygous knockout mice for the CYP7A1 gene, it was reported 23 ; that most of the homozygotes died at, or shortly after birth, unless they and their mothers were fed a diet supplemented with bile acids and fat soluble vitamins. Both women complained to their physicians that they had not given permission for their confidential health information to be released to defendants. JFK filed suit to enjoin defendants' use or disclosure of confidential health information and to compel defendants to return such information to JFK. In a November 2005 opinion, the appeals court found the district court properly denied the hospital's action because the hospital did not have standing under either the common law or under HIPAA to assert the privacy right of a third party. The hospital petitioned for certification to the New Jersey Supreme Court, arguing that it had standing in its own right to protect its business records. The high court filed an order remanding the case for resolution of the standing issue. On remand, the appeals court found the hospital had standing to protect its business records. The appeals court first noted that "the power to grant corporate entities injunctive relief to protect their business, custom and profits is firmly established and not dependent on pre-existing express agreements with the individuals against whom the restraints are sought." According to the court, the "right asserted here by the hospital is, if anything, weightier than the right of a corporation to protect its trade secrets because the foundation of that right is not merely self-protection." The appeals court added that "recognition of that right would tend to enhance patients' privacy, thus serving the mandate of the Hospital Patients Bill of Rights Act."
